NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. WINNERS WILL BE CHOSEN AT RANDOM.
SWEEPSTAKES ENTRY PERIOD: The LOFT “Love List Holiday Giveaway” Sweepstakes (“Sweepstakes” or “Promotion”) begins at 12:01 AM Eastern Time (“ET”) on Monday, November 29, 2010 and ends at 11:59 PM (“ET”) on Thursday, December 23, 2010 (“Sweepstakes Entry Period”). There will be twenty-five (25) Daily Entry Periods during the Sweepstakes Entry Period (see below chart for details) and one (1) Grand Prize Winner random drawing on or around 12/28/10.
ELIGIBILITY: The LOFT “Love List Holiday Giveaway” Sweepstakes is open to legal residents of the 50 United States and the District of Columbia (U.S.), age 18 or older at the time of entry. Void outside the United States, in Puerto Rico, and wherever else prohibited by law. Employees of AnnTaylor, Inc., 7 Times Square Tower, New York, NY 10036 (the "Sponsor"), and its subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members of, and/or those living in the same household of each, are not eligible to enter. Sweepstakes is subject to all applicable federal, state and local laws and regulations.
HOW TO ENTER: The Promotion is a daily Instant-Win Game featuring an electronic slot-machine device (the “Slot-Machine”). To enter, visit www.loftlovelist.com, complete the online registration form in its entirety, including a valid email address and a password (for future visits), check the box to agree to and accept the terms of the Official Rules and submit to be taken to the Slot-Machine. Click the Slot-Machine to play and you will be shown your winner or non-winner status at the end of the spin. By registering, you will receive one (1) Instant-Win Game play. Each day thereafter, during the Sweepstakes Entry Period, you will be able to return to the site, enter your email address and password that you used for registration and play the Instant-Win Game once per day.
Limit: One (1) Instant-Win Game play per person (regardless of whether the person has more than one email address) during each day of the Sweepstakes Entry Period.
In the event of a dispute, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries made by any other individual or entity that is not the person named on the submitted entry, or made in any manner inconsistent with these Official Rules, will be declared invalid and disqualified from this Promotion. All winning claims are subject to verification by Sponsor and/or the Sweepstakes Administrator, whose decisions are binding.
Even if the Instant-Win Game shows that you are a winner, you are not a winner until your eligibility and the potential winning game-play has been verified. No proof of winning will be accepted. Only the Sweepstakes Administrator’s verification process shall be conclusive and final.
All entries and requests become Sponsor’s property and will not be returned or acknowledged.
PRIZES & APPROXIMATE RETAIL VALUES (“ARV”):
Grand Prize: One (1) Grand Prize will be awarded of twenty-five (25) LOFT “must-have” holiday gifts with a range in value from $24.50 - $138.00, noted in the chart below, which has a Total ARV of $1,379.50.
Instant-Win Prizes: Twenty-five (25) Instant-win Prizes of various LOFT “must-have” holiday gifts with a range in value from $24.50 - $138.00, noted in the chart below, will be awarded during the twenty-five (25) Daily Entry Periods.
Total ARV of all prizes available to be won: $2,759.00.
PRIZE DRAWINGS: There will be twenty-five (25) Daily Entry Periods during the Sweepstakes Entry Period (each, a “Daily Entry Period”). Beginning November 29, 2010 and on each day thereafter, as noted in the chart below, one daily Instant-win Prize will be awarded over a period of 25 days. Prizewinners will be selected in a series of random instant-win drawings from among all eligible entries received within the corresponding Daily Entry Period. To be eligible for the first Daily Entry Period, your online entry must be received between 12:01 AM (ET) on 11/29/2010 and 11:59 PM (ET) on 11/29/2010. For each subsequent Daily Entry Period thereafter, your online entry must be received between 12:01 AM (ET) and 11:59 PM (ET) as noted in the chart below. Non-winning entries from each Daily Entry Period will not be rolled over to the subsequent Daily Entry Period. They will only be eligible to win a prize for the day during which they are received. All entries received during the Sweepstakes Entry Period will be eligible to win the Grand Prize.
One (1) Grand Prize Winner will be selected and notified of their selection, in a random drawing from among all eligible entries received during the Sweepstakes Entry Period, on or about Tuesday, December 28, 2010, at the offices of The US Sweepstakes & Fulfillment Company, an independent agent of the Sponsor whose decisions are final. Odds of winning a Grand Prize depend on the total number of eligible entries received during each day of the Sweepstakes Entry Period. All eligible entries received during the Sweepstakes Entry Period for the daily Instant-Win Games will automatically be included in the random drawing for the Grand Prize. No separate entry is required.

If you are the first player to successfully play the Instant-Win Game at or after a selected winning time, you will be a potential winner (pending confirmation) of the prize. Odds of winning an Instant-win Prize depends on the total number of eligible entries received during each day of the Sweepstakes Entry Period.
WINNER NOTIFICATION: The LOFT “Love List Holiday Giveaway” Sweepstakes is under the administration of the US Sweepstakes & Fulfillment Company, an independent agent of the Sponsor whose decisions are final.
The Grand Prize Winner will be confirmed via email and/or phone, and will be required to sign and return, within ten (10) days of notification, an Affidavit of Eligibility and a Liability Waiver and where allowable, a Publicity Release (collectively, the “Releases”). Noncompliance will result in disqualification and an alternate winner being selected. Winner is responsible for all federal, state, local and income taxes associated with winning prize. Winner will be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law.
Daily Prize Winners will be notified by email on the actual date they have won the prize and requested to confirm their mailing address via return email. Each Daily Prize Winner will be required to sign and return, within ten (10) days of notification, the Releases. Noncompliance will result in disqualification and an alternate winner being selected. Winner is responsible for all federal, state, local and income taxes associated with winning prize. Winner will be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law. Prizes will be sent to the mailing address on the entry form or new mailing address provided via email response from potential winner within 4-6 weeks of winner being verified.
PRIZE CONDITIONS: If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian. The parent/legal guardian of the winner shall be responsible for all taxes on prize, if applicable.
If prize notification is returned as undeliverable or if a selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the corresponding prize will be forfeited and an alternate winner will be selected in a separate random drawing. Prizes are not redeemable for cash. Prizes are not exchangeable (for a different size, color or product). Prizes are not assignable or transferable. No substitution is permitted except if prize or prize component is unavailable, in which case a prize of equal or greater value will be awarded. Any other incidental expenses on prize not specified herein are the sole responsibility of each winner. Except where prohibited by law, entry and acceptance of prize constitute permission to use each winner's name, prize won, hometown, likeness for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission. Winner is responsible for all federal, state, and local sales and income taxes, if applicable.
Winner acknowledges that the Sponsor and all other businesses affiliated with this Sweepstakes and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative the quality, conditions, fitness or merchantability of any aspect of the prize being offered.
TERMS AND CONDITIONS: This Promotion is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and Sweepstakes Administrator, and waive any right to claim ambiguity in regard to the Promotion mechanics, and/or the interpretation of these Official Rules. All entrants, and any selected winners, agree to release, discharge, indemnify and hold harmless the Sponsor, any vendors/prize providers that may be associated with this Promotion, and the respective officers and employees of these entities, from and against any claims, damages or liability due to any injuries, damages or losses to any person or property of any kind resulting in whole or in any part, directly or indirectly, from participation in this promotion, or for any prizes won.
PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTY, GUARANTEE OR REPRESENTATION OF ANY KIND, EXPRESSED OR IMPLIED (INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).
LIMITATIONS OF LIABILITY: Incomplete, corrupted or untimely entries are void and will be disqualified. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. Sponsor and its agencies are not responsible for incomplete, lost, untimely, illegible, or otherwise destroyed or corrupted entries or game piece requests or for incomplete, lost, interrupted or unavailable network, server or other connections, miscommunications, computer or software malfunctions or telephone transmission problems or technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind whether human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. The website’s database clock will be the official timekeeper for this Promotion. Sponsor reserves the right at its sole discretion to modify or cancel this Promotion at any time for any reason without notice or obligation. The Sponsor is not responsible for any typographical or other error in the advertising for the Sweepstakes, administration of the Sweepstakes or in the announcement of the Prizes. Sponsor is not responsible if Sweepstakes cannot take place or if Prizes cannot be awarded due to cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. Sponsor, its affiliated companies, parents, subsidiaries, officers, directors, and agents are not responsible for any incorrect or inaccurate information, including, without limitation, that are caused by website users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the processing of submissions in the Promotion. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Promotion. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor may, in its sole discretion, void any suspect entries and (a) cancel, modify or terminate the Promotion (or any portion thereof); (b) modify the Promotion or suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (c) award the prizes from among the eligible, non-suspect entries received up to the time of the impairment. Sponsor is not responsible for any technical or human error which may occur in processing entries for random drawings.
Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
APPLICABLE LAWS AND JURISDICTION: Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by and interpreted under the laws of the State of New York without regard to its conflicts of laws provisions. By participating, entrants agree that any and all disputes arising out of or relating in any way to this Sweepstakes shall be resolved individually, and without resort to class action, exclusively by a state or federal court located in New York, New York. Should there be a conflict between the laws of the State of New York and any other laws, the conflict will be resolved in favor of the laws of the State of New York. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Sweepstakes and shall not include any indirect, punitive, incidental and/or consequential damages.
PRIVACY: By entering and providing the required entry information, Entrants acknowledge that the Sponsor may also send information, samples or special offers it believes may be of interest to Entrant, or other information or goods offered by its marketing partners.
